Litigation is responsible for providing Legal advice, counsel and services in the area of litigation, including managing and resolving disputes, bringing affirmative actions, defending actions brought against the organization, facilitating alternative dispute resolution, and preventing litigation.

  • J.D. with a record of high academic achievement at the undergraduate level and in law school
  • License to practice law in Ohio or active bar license in another state.
  • Minimum of 2-3 years of bankruptcy and credit/collection experience
  • General litigation experience
  • Experience with a well-established law firm and/or corporate legal department preferred
  • Demonstrated leadership capabilities
  • The ability to issue spot and present positive, creative solutions and alternatives
  • Excellent oral and written communication skills; acute attention to detail
  • Outstanding interpersonal skills, including diplomacy and flexibility, and the ability to interface effectively and engender trust and confidence with personnel at many different levels throughout the Company
  • Enthusiasm and “self-starter” qualities enabling management of responsibilities with an appropriate sense of urgency; the ability to function effectively and efficiently in a fast-paced and dynamic environment
  • Demonstrates a high level of professionalism, including the ability to be flexible with others, to display tact, diplomacy and discretion and maintain integrity of confidential and sensitive information
  • Proficiency with computers, including strong word processing skills
  • Proficiency with software used to manage electronically stored information

Assist in the management of all credit, collection and bankruptcy matters involving the Company, including:
  • Reporting to the Vice President and Associate General Counsel and working with the credit team to supervise the Company’s credit portfolio and collection and bankruptcy litigation
  • Supervising the Company’s outside counsel and providing strategic direction and guidance to outside counsel with respect to the Company’s strategies, policies and objectives
  • Ensuring the cost-effective use of outside counsel, through the use of preferred providers, technology, alternative fee arrangements, and budget adherence
  • Coordinating with other Company lawyers and management, as appropriate, to ensure collection and bankruptcy matters that affect business units are handled in a timely, efficient, and cost-effective manner, and that other Company lawyers are well-informed about matters relating to their business units
  • Performing miscellaneous credit-related tasks arising on a day-to-day basis, including issuing demand letter, structuring settlement and work-out agreement, preparing and reviewing subordination and intercreditor agreements
  • Preparing preference defense analysis and responding to preference complaints and demands
  • Structuring loan transactions and preparing applicable documentation and agreements
  • Demonstrating knowledge of litigation rules, eDiscovery techniques and document reviews
  • Providing counsel and guidance in connection with bankruptcy and collection strategies, while fully complying with applicable laws and avoiding unacceptable risks; and providing informed cost-benefit analysis when identifying risks
  • Developing a thorough understanding of and familiarity with the Company’s business, its people, products, markets, facilities, customers and competitors to identify trends and formulate strategies accordingly
  • Establishing good rapport and working relationships with management at all levels
  • Keeping the Vice President and Associate General Counsel and senior management abreast of significant decisions and other rulings that may affect the Company’s business or credit policies
  • Performing special assignments or projects, including process improvement projects, as assigned by the Vice President and Associate General Counsel, including: employee education presentations and training, drafting of policies or procedures and case law updates
