Definition:
Performs difficult legal work in representing the Board of Supervisors, the County and its departments/agencies on legal issues and in litigation involving complex issues of public agency and civil law.

Classification standards:
These journey level positions are allocated only to the Office of the County Counsel. Deputy County Counsel positions are characterized by and responsible for assignments involving a full range of matters involving complex issues, the resolution of which have the potential to negatively impact the County's programs, policies or operations or may result in serious monetary losses. Incumbents are expected to exercise well-developed legal skills and knowledge and act independently under general oversight and direction.

Essential Job Functions
  • Provides in-depth legal advice to the Board of Supervisors and Health Agency and County departments (Health Services, Mental Health and Public Health) on transactional and limited litigation matters.
  • Is assigned, both directly and through supervision, litigation involving health and mental healthcare payors and administrative hearings.
  • Acts as legal advisor to County departments and participates in the resolution of difficult legal questions regarding powers, procedures and operations.
  • Provides analysis and advice to the Board of Supervisors and Health Agency and County departments (Health Services, Mental Health and Public Health), on regulatory healthcare laws including: Medicaid/Medi-Cal, Medicare and Anti-Kickback.

Requirements
Selection requirements:
Three years' experience in the practice of civil law; two years of which must include experience in healthcare law.

License:
Admission to practice law in all courts of California.

Desirable qualifications:
Knowledge and experience of the Health Insurance Portability and Accountability Act (HIPAA), consent and confidentiality of medical information; medical staff issues; healthcare compliance; Emergency Medical Treatment & Labor Act (EMTALA); hospital licensing, certification and accreditation; and, managed care and Knox-Keene Act.

Eligibility information:
The names of candidates receiving a passing grade in the examination will be placed on the eligible register in the order of their score group for a period of twelve months following the date of promulgation.
Applicants will be processed on an as-received basis and promulgated to the eligible register accordingly.
