Description:
This position is responsible for handling lawsuits, claims and charges brought against the Company, primarily concerning labor and employment matters, as well as advising the Company on labor relations and providing general legal advice and guidance to the business departments.

Key Responsibilities:
  • Researches and maintains current, robust knowledge of laws or regulations applicable to the Company’s operations, with a primary focus on labor and employment matters
  • Oversees and manages litigation matters, with a primary but not exclusive focus on labor and employment matters
  • Supervises outside litigation counsel
  • Manages and coordinates Company’s response to inquiries and investigations by the Department of Labor or EEOC
  • Manages discovery process
  • Initiates and manages employment related claims on behalf of the Company
  • Handles small claims lawsuits independently
  • Reviews and responds to claims and demand letters, primarily employee-related
  • Investigates and responds to EEOC charges
  • Participates in mediations, depositions, arbitrations and trial, as necessary
  • Assesses Company’s compliance with applicable laws and regulations
  • Develops and implements processes and procedures to monitor and ensure compliance with applicable laws and regulations, with a primary but not exclusive focus on labor and employment matters
  • Evaluates Company operations for areas of risk or weakness
  • Evaluates and advises Human Resources Dept regarding payroll matters, including commission plans, and makes documentary revisions as necessary
  • Participates with Human Resource Dept in mitigating risks in employment areas
  • Develops and maintains practices and processes regarding labor relations
  • Identifies training needs and provides training to managers and relevant departments
  • Manages union discussions and relationships
  • Coordinates and reviews the development of training materials
  • Participates in strategic analysis and projects as requested
  • Completes other projects and special assignments as requested by supervisor and/or Senior Management

Key Accountabilities:
  • Manages litigation activities, primarily relating to labor and employment matters
  • Provides legal advice and guidance with the expectation of minimizing risks while allowing the business to operate and remain flexible
  • Maintains robust and current knowledge of applicable laws and regulations

Knowledge Requirements:
  • Microsoft Office products
  • Labor and employment laws
  • Contract review
  • Union activities

Professional Experience
  • 6+ years of legal experience
  • 2+ years of trial experience

Education/Training
  • JD from an ABA approved law school
  • Bar membership
  • Licensed to practice in Texas
